Welcome to OmniSave. These Terms and Conditions (“Terms”) govern your access to and use of the OmniSave website, services, features, and related content (collectively, the “Service”).

By accessing or using OmniSave, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.

1. About OmniSave

OmniSave is a price-comparison and product-information service designed to help users compare products, prices, and offers from third-party retailers.

OmniSave does not directly sell, manufacture, stock, ship, or fulfill the products displayed on the Service unless expressly stated otherwise.

When you select a retailer link, you may be redirected to a third-party retailer’s website to complete your purchase.

2. Eligibility

You may use OmniSave only in compliance with applicable laws and these Terms.

By using the Service, you represent that you have the legal capacity to agree to these Terms.

3. Product Information

OmniSave may display product information including, but not limited to:

  • Product names

  • Images

  • Specifications

  • Descriptions or summaries

  • Model numbers

  • Manufacturer part numbers

  • Retailer information

  • Pricing

  • Promotions

  • Availability

  • Historical pricing information

We attempt to provide useful and accurate information, but we do not guarantee that all product information is complete, current, or error-free.

Users should verify important product specifications and compatibility information with the manufacturer or retailer before making a purchase.

4. Pricing Information

Prices displayed on OmniSave are collected or obtained from third-party retailers and other sources.

Although we make reasonable efforts to keep pricing information current, prices may change at any time without notice.

The price displayed on OmniSave may differ from the price displayed by the retailer when you visit the retailer's website.

The retailer's price at the time of purchase controls the transaction.

5. Currency, Taxes, Shipping and Other Charges

Unless otherwise indicated, prices displayed by OmniSave are generally presented in Canadian dollars (CAD).

Displayed prices may not include applicable taxes, shipping charges, environmental fees, duties, handling charges, membership requirements, or other costs imposed by a retailer or other third party.

Users should review the retailer's final checkout price before completing a purchase.

6. Promotions and Discounts

Retailers may offer temporary sales, promotional pricing, coupons, rebates, bundles, member pricing, or other discounts.

OmniSave does not guarantee that a promotion displayed through the Service remains available.

Eligibility requirements, exclusions, expiration dates, purchase limits, and other promotional conditions are determined by the applicable retailer.

7. Average, Reference and Comparison Prices

OmniSave may display reference information such as an average price, typical price, previous price, or other comparison value.

These values are provided for informational purposes and may be calculated using pricing information available to OmniSave.

They should not necessarily be interpreted as a manufacturer's suggested retail price (“MSRP”) unless specifically identified as such based on reliable information.

Reference prices do not guarantee that a product was previously sold at that price by every retailer.

8. Price History

OmniSave may maintain historical pricing information for products and retailers.

Price-history information reflects data available to OmniSave during the period being tracked and may not represent every price, promotion, retailer, or transaction that occurred during that period.

Historical pricing does not guarantee future pricing.

9. Lowest Price Information

Statements such as “lowest price,” “lowest price today,” “best price,” or similar wording refer only to the retailers, products, and pricing information tracked or available to OmniSave at the relevant time.

They do not necessarily mean that the displayed price is the lowest price available anywhere in Canada or from every possible seller.

Other retailers, marketplaces, local stores, membership programs, coupons, or promotions may offer different prices.

10. Data Updates and Timestamps

OmniSave may display the time or date on which product or pricing information was last updated.

A timestamp indicates when OmniSave last obtained or processed the applicable information. It does not guarantee that the information remains unchanged after that time.

Retailers may modify prices, availability, promotions, or product information between OmniSave updates.

11. Third-Party and Automated Data

Certain information displayed through OmniSave may be obtained through automated collection methods, retailer websites, APIs, data feeds, affiliate networks, manufacturers, or other third-party sources.

Automated systems may occasionally collect inaccurate, incomplete, outdated, duplicated, or mismatched information.

OmniSave may review, correct, remove, or update information when errors are discovered but does not guarantee that every error will be detected immediately.

12. Product Availability

Product availability is controlled by third-party retailers and may change without notice.

A product shown as available through OmniSave may be unavailable, backordered, discontinued, limited to certain locations, or otherwise unavailable when you visit the retailer.

OmniSave does not guarantee inventory or product availability.

13. Retailer Transactions

Purchases made after following a link from OmniSave are transactions between you and the applicable third-party retailer.

OmniSave is not a party to those transactions.

The retailer is responsible for matters including:

  • Payment processing

  • Order acceptance

  • Shipping and delivery

  • Product warranties

  • Returns

  • Refunds

  • Exchanges

  • Customer service

  • Taxes and fees

  • Product condition and authenticity

Any dispute concerning a purchase should generally be addressed with the retailer involved.

14. Third-Party Websites

OmniSave contains links to websites and services operated by third parties.

We do not control those websites and are not responsible for their content, availability, security, privacy practices, terms, products, or services.

A link from OmniSave does not necessarily constitute an endorsement, sponsorship, partnership, or affiliation.

Users access third-party websites at their own discretion.

15. Affiliate Links

Some links on OmniSave may be affiliate links.

If you click an affiliate link and make a qualifying purchase, OmniSave may receive a commission from the retailer or affiliate network at no additional cost to you.

Affiliate relationships do not guarantee the accuracy, quality, availability, or suitability of a retailer's products or services.

16. Accounts

Certain OmniSave features may require a user account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree to provide accurate information and to notify OmniSave if you believe your account has been accessed without authorization.

We may suspend or terminate accounts that violate these Terms or are used fraudulently, unlawfully, or abusively.

17. Price Alerts and Notifications

OmniSave may allow users to create price alerts or receive other notifications.

Alerts are provided as a convenience and are not guaranteed to be delivered immediately or at all.

Technical issues, retailer changes, data delays, email filtering, notification settings, or other circumstances may affect delivery.

Users should independently verify the current retailer price before making purchasing decisions.

18. Acceptable Use

You agree not to:

  • Use OmniSave for unlawful purposes

  • Attempt to gain unauthorized access to the Service or its systems

  • Interfere with the operation or security of the Service

  • Introduce malware or harmful code

  • Attempt to circumvent security measures

  • Use automated systems in a manner that places an unreasonable burden on the Service

  • Misrepresent your identity or affiliation

  • Use the Service to violate the rights of another person or entity

We may restrict access to users who violate these Terms.

19. Intellectual Property

Unless otherwise stated, OmniSave's original website design, branding, software, layout, graphics, databases, and original content are owned by or licensed to OmniSave and are protected by applicable intellectual-property laws.

Third-party trademarks, logos, product names, images, descriptions, and other materials remain the property of their respective owners.

Reference to a third-party brand, manufacturer, or retailer does not imply sponsorship, endorsement, partnership, or affiliation unless expressly stated.

20. Intellectual Property Complaints

OmniSave respects intellectual-property rights.

If you believe content appearing on OmniSave infringes your copyright, trademark, or other intellectual-property rights, please contact us and provide sufficient information to identify the material and the rights involved.

We may investigate complaints and remove, disable, or modify material where appropriate.

21. Errors and Corrections

OmniSave may contain typographical errors, technical errors, incorrect product matches, inaccurate prices, missing information, or other mistakes.

We reserve the right to correct, modify, or remove information at any time without notice.

We are not obligated to continue displaying information merely because it was previously available through the Service.

22. Service Availability and Changes

We may modify, suspend, discontinue, restrict, or update any portion of OmniSave at any time.

We do not guarantee uninterrupted or error-free access to the Service.

Maintenance, technical problems, third-party outages, security issues, or circumstances outside our control may temporarily affect availability.

To the maximum extent permitted by applicable law, OmniSave and the Service are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • Every retailer or available price will be included

  • The Service will always be available or error-free

  • Price alerts or notifications will always be delivered

  • Products will remain available at displayed prices

  • Third-party products or services will meet your expectations

You are responsible for verifying information that is important to your purchasing decisions.

24. Limitation of Liability

To the maximum extent permitted by applicable law, OmniSave and its owners, operators, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service.

This includes, where permitted by law, losses arising from:

  • Incorrect or outdated pricing

  • Product-information errors

  • Retailer actions or omissions

  • Unavailable products

  • Failed or delayed notifications

  • Third-party websites

  • Purchases made from third-party retailers

  • Service interruptions

  • Loss of data

  • Unauthorized access outside OmniSave's reasonable control

Nothing in these Terms limits rights that cannot lawfully be waived or restricted under applicable consumer protection or other mandatory laws.

25. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless OmniSave and its owners, operators, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Service, your violation of these Terms, or your infringement of another party's rights.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our business practices, or applicable legal requirements.

When the Terms are updated, the “Last Updated” date at the top of this page may be changed.

Your continued use of OmniSave after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any dispute relating to these Terms or the Service will be handled in accordance with applicable law.
